1. Acceptance of Terms
By accessing or using the KasaStay website or mobile applications ("Platform"), you agree to these Terms of Service ("Terms") and our Privacy Policy.
If you do not agree to these Terms, you must not use the Platform.
KasaStay reserves the right to modify these Terms at any time. Updated Terms will be effective upon publication on the Platform. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
2. About KasaStay
KasaStay is a digital marketplace platform that connects property owners, agents, and renters for short stays, long stays, and commercial properties.
KasaStay:
- Does not own, lease, or manage any listed property
- Does not act as landlord, property manager, or real estate broker
- Does not guarantee occupancy, rental income, or property performance
KasaStay operates solely as an intermediary facilitating visibility, communication, and payment processing between users.
3. User Accounts
To list or book a property, users must create an account with accurate, complete, and up-to-date information.
Users are responsible for:
- Maintaining the confidentiality of login credentials
- All activities conducted under their account
KasaStay reserves the right to suspend, restrict, or permanently delete accounts involved in fraud, illegal activity, payment abuse, chargebacks, or misuse of the Platform.
4. Property Listings
Property owners and agents are solely responsible for:
- Accuracy of listings (photos, descriptions, prices, availability)
- Legal right to rent, advertise, or sublease the property
- Compliance with local laws, taxes, licensing, and regulations
By listing a property, you confirm you have full legal authority to do so.
Hosts are solely responsible for compliance with all applicable local laws, taxes, licensing requirements, zoning regulations, and other regulatory obligations related to their properties.
KasaStay reserves the right to remove, suspend, or hide listings that:
- Violate applicable laws
- Contain misleading information
- Breach quality or safety standards
Verified and Kasa’s Choice badges are assigned based on internal criteria. KasaStay may grant, suspend, or withdraw badges at its sole discretion.
5. Bookings and Payments
5.1 Agency Role
KasaStay acts as a commercial agent of the Host for the limited purpose of facilitating bookings and processing payments.
KasaStay does not act as a bank, escrow institution, or licensed financial services provider.
Payments collected through the Platform are received on behalf of the Host.
5.2 Payment Processing
Payments may be processed through authorized third-party providers, including but not limited to:
- Stripe (international card payments)
- KoraPay (mobile money payments)
By completing a booking, the User authorizes KasaStay and its payment providers to:
- Charge the total booking amount
- Apply applicable service fees or processing fees
- Deduct platform commissions where applicable
All payments are subject to:
- Fraud screening
- Risk assessment
- Payment provider authorization
- Settlement timelines
Payment authorization does not guarantee immediate fund availability.
5.3 Fees
KasaStay may charge:
- Platform service fees
- Mobile money processing fees
- International card processing fees
- Subscription fees (where applicable)
All applicable fees will be displayed prior to final payment confirmation.
Payment provider fees may vary depending on payment method.
Certain processing fees may be non-refundable.
5.4 Settlement and Host Payouts
For short stays, Host payouts are generally released 24 hours after guest check-in, provided that:
- Payment has fully settled
- Funds are available from the payment provider
- No active dispute, fraud alert, chargeback, or refund request exists
KasaStay reserves the right to delay or withhold payouts where:
- A transaction is flagged for fraud
- A chargeback or dispute is initiated
- Risk indicators are triggered
- Legal or regulatory review is required
KasaStay is not obligated to advance funds to Hosts prior to settlement of the underlying transaction.
5.5 Chargebacks and Payment Reversals
In the event of:
- Chargebacks
- Fraudulent transactions
- Payment reversals
- Bank disputes
KasaStay may recover corresponding amounts from:
- Pending payouts
- Future payouts
- Other amounts owed to the Host
Hosts acknowledge that chargeback risk is inherent in online transactions.
5.6 Cancellations and Refunds
Refunds are governed by the cancellation policy selected for the listing.
Where a refund is issued:
- Payment provider fees may not be recoverable
- Processing fees may remain non-refundable
- Settlement timing may be impacted
KasaStay is not liable for cancellation disputes between Hosts and Guests.
6. Subscriptions (Long Stay & Commercial Properties)
Long stay and commercial property owners may purchase subscription packages.
Subscription fees:
- Are non-refundable
- Do not guarantee bookings
- Do not guarantee visibility ranking
KasaStay reserves the right to modify subscription pricing or features at any time.
7. User Conduct
Users agree not to:
- Post false, misleading, or illegal information
- Use the Platform for fraud, money laundering, or unlawful activity
- Circumvent payment systems to avoid fees
- Upload harmful or unauthorized content
- Attempt to hack, disrupt, or reverse engineer the Platform
Violation may result in account suspension, termination, and legal action.
8. Verification & Identity
KasaStay may request identity verification documents from users.
Verification does not guarantee legitimacy of property, legal compliance, or safety of transactions.
KasaStay reserves the right to request additional documentation at any time.
9. Liability Disclaimer
The Platform is provided "as is" and "as available."
KasaStay does not guarantee continuous availability, error-free operation, or booking success.
KasaStay is not responsible for:
- Accuracy or legality of listings
- Property conditions
- Damages, theft, or loss during stays
- Payment delays caused by third-party providers
- Chargebacks initiated by financial institutions
To the maximum extent permitted by law, KasaStay’s total liability shall not exceed the amount of fees paid by the user to KasaStay for the specific transaction giving rise to the claim.
10. Intellectual Property
All content, branding, software, badges, and design elements of KasaStay are the exclusive property of EL&L Bright Properties LLC.
Unauthorized reproduction or redistribution is prohibited.
11. Data Protection
KasaStay processes user data in accordance with applicable data protection laws.
Personal data may be used for:
- Account verification
- Fraud prevention
- Payment processing
- Platform improvement

12. Termination
KasaStay may suspend or terminate accounts at its sole discretion where these Terms are violated.
Users may delete their accounts at any time, subject to resolution of outstanding transactions.
13. Dispute Resolution
Disputes shall first be resolved amicably.
If unresolved, disputes shall be governed by the laws of Cameroon.
Exclusive jurisdiction shall lie with the Courts of Yaoundé.

In case of inconsistency, the English version shall prevail.
